TERMS AND CONDITIONS – DiamGlow

1. Seller Information

This online store (the "Store") is operated by:

The Seller conducts business in the form of a non-registered business activity under Article 5 of the Polish Entrepreneurs' Law. This form of activity is legally permitted under Polish law and does not affect the validity or enforceability of contracts concluded through the Store. The Seller remains fully responsible to consumers under applicable consumer protection laws.

2. Nature of the Business – Dropshipping Model

The Store operates under a dropshipping model. Products offered in the Store are fulfilled through external suppliers and logistics partners. Orders may be shipped directly from manufacturers, warehouses, or third-party fulfillment centers, including those located outside the European Union. The Seller does not necessarily stock products physically in Poland. The Seller remains responsible toward the Customer for proper performance of the sales contract.

3. Orders and Contract Formation

Product listings constitute an invitation to conclude a contract. A sales contract is concluded when the Customer receives order confirmation via email.

The Seller reserves the right to cancel orders in case of:

  • pricing errors
  • product unavailability
  • suspected fraud

4. Prices and Payments

Prices are displayed in PLN and include VAT where applicable.

Customers are responsible for:

  • customs duties
  • import taxes
  • local charges if goods are shipped from outside the EU

5. Shipping and Delivery

5.1 Delivery Model

Orders are processed via external suppliers and may be shipped from outside the Customer's country.

5.2 Estimated Delivery Time

Estimated delivery time: 5–15 business days.

Delivery times are estimates and may vary depending on destination country. They may be affected by customs clearance, logistics delays, or force majeure events.

The Seller is not responsible for delays caused by:

  • customs authorities
  • postal operators
  • courier companies
  • events beyond reasonable control

5.3 Risk and Responsibility for Delivery

The Seller is responsible for the goods until they are delivered to the Customer. Risk of loss or damage transfers to the Customer only upon physical receipt of the goods by the Customer or a person designated by the Customer.

6. Right of Withdrawal (EU Consumers)

If you are a consumer residing in the European Union, you have the right to withdraw from the contract within 14 days without giving any reason.

6.1 Withdrawal Period

The withdrawal period expires 14 days after the day you receive the goods.

6.2 How to Exercise the Right

You may use any clear written form (email is sufficient).

6.3 Return Address

Due to the dropshipping model, returns may need to be sent to a designated return warehouse.

Return address - after confirmation by email.
DO NOT send returns without prior contact.

6.4 Return Deadline

Goods must be returned within 14 days from the date of withdrawal notification.

6.5 Cost of Return

The Customer bears the direct cost of returning the goods, unless otherwise agreed.

6.6 Refund

Refunds are issued within 14 days from receiving the withdrawal notice. The Seller may withhold reimbursement until goods are received or proof of return is provided. Refunds are made using the original payment method.

7. Exceptions to Withdrawal

The right of withdrawal does not apply to:

  • customized or personalized products
  • sealed goods unsealed after delivery for hygiene reasons
  • goods that deteriorate rapidly

8. Complaints (Defective or Non-Conforming Goods)

The Seller is liable for lack of conformity of goods with the contract under applicable consumer protection laws. The Seller cannot exclude or transfer this responsibility to suppliers.

8.1 How to File a Complaint

Complaints must be submitted to:

Complaint must include:

  • Customer's name
  • order number
  • description of defect
  • photos (if possible)
  • preferred resolution

8.2 Complaint Handling Time

The Seller will respond within 14 days of receiving the complaint. If no response is given within 14 days, the complaint is deemed accepted.

9. Import Outside the EU

Some products may be shipped from outside the European Union.

Customers acknowledge that:

  • delivery times may be longer
  • customs procedures may apply
  • import duties or taxes may be charged depending on local regulations

The Seller is not responsible for customs clearance delays.

10. Liability

The Seller is responsible for proper performance of the sales contract. The Seller remains legally responsible toward consumers under applicable law.

11. Data Protection

Personal data is processed in accordance with the Privacy Policy available on the website.

12. Governing Law

These Terms are governed by Polish law. EU consumers are additionally protected by mandatory provisions of the law of their country of residence.

14. Consumer Rights Protection

Nothing in these Terms limits or excludes any consumer rights granted under mandatory provisions of the law applicable in the consumer's country of residence. If local consumer protection laws provide greater rights or protections than those set out in these Terms, such laws shall prevail.
